Terms & Conditions

Welcome to People Welfare Scheme ("PWS", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of our direct-selling platform, mobile application, and website (collectively, the "Platform"). By registering on our Platform or using our services, you agree to be bound by these Terms.

1. Eligibility

To register on the Platform, you must:

  • Be at least 18 years of age
  • Be a resident of India with a valid UPI-enabled bank account
  • Have a valid PAN card (required for commission payouts exceeding ₹15,000 cumulative)
  • Have been referred by an existing PWS member via a valid referral link

2. Registration & Product Purchase

Registration on PWS requires a one-time payment of ₹500 (Indian Rupees) via UPI. This fee covers:

  • A genuine physical product (starter kit) shipped to your registered address
  • Access to the PWS platform and your personal referral link
  • Eligibility to earn affiliate commissions on downstream product sales

Self-registration without a referral link is not permitted. Payment methods other than UPI are not accepted.

3. Product & Delivery

Upon successful payment, a physical product will be shipped to the address provided during registration. Delivery timelines depend on your location and the shipping partner's SLA, typically 5–10 business days within Tamil Nadu and 7–14 business days elsewhere in India. Tracking information will be provided via SMS.

4. Referral & Commission Structure

PWS operates a 6-way matrix with up to 5 levels of affiliate commission on genuine product sales:

  • Level 1: ₹500 one-time when your 6 direct referrals complete their product purchase
  • Levels 2–5: ₹400 per set-of-6 completions under your downline, up to 5 levels deep

Commissions are earned on actual product sales and not on recruitment. There is no mandatory recruitment quota. Maximum earning potential is ₹6,22,100 over all 5 levels.

5. Commission Payouts

  • Commissions are paid to your verified UPI ID after a T+2 (48-hour) settlement period from set completion
  • UPI ID verification via penny-drop is mandatory before any payout
  • PAN is required when cumulative commissions exceed ₹15,000 (for TDS compliance under Section 194H)
  • PWS reserves the right to withhold payouts pending fraud review or regulatory compliance

6. Refund & Return Policy

You have the right to return the product within 30 days of delivery for a full refund of ₹500 ("cooling-off period"), in accordance with the Consumer Protection (Direct Selling) Rules, 2021. Upon return:

  • Your registration will be deactivated
  • Your referral link will be expired
  • Any pending commissions will be forfeited
  • Downline commission adjustments will be processed proportionally

7. Prohibited Conduct

You agree not to:

  • Make false income claims or guarantees to prospective referrals
  • Misrepresent the product or the PWS business model
  • Use automated tools, bots, or scripts to register accounts or generate referrals
  • Register multiple accounts using different identities
  • Engage in fraudulent activity, money laundering, or any illegal conduct
  • Impersonate another person or provide false registration information

8. Account Suspension & Banning

PWS reserves the right to suspend or permanently ban your account for violation of these Terms. Upon banning:

  • All pending and unpaid commissions are forfeited
  • Your referral link is immediately expired
  • Your downline continues independently; the banned user is skipped in commission calculations
  • Banned users may appeal by contacting the Grievance Officer within 30 days

9. Intellectual Property

All content, branding, logos, and software on the Platform are the intellectual property of People Welfare Scheme. You may not copy, reproduce, or distribute any Platform materials without written permission.

10. Limitation of Liability

PWS is not liable for:

  • Income expectations — earnings depend entirely on your referral activity and are not guaranteed
  • UPI payment failures or delays caused by third-party payment gateways
  • Shipping delays caused by logistics partners
  • Losses arising from unauthorized access to your account due to your negligence

11. Compliance

PWS operates in compliance with:

  • Consumer Protection (Direct Selling) Rules, 2021
  • Digital Personal Data Protection Act, 2023 (DPDPA)
  • Income Tax Act — Section 194H (TDS on commission)
  • Prize Chits and Money Circulation Schemes (Banning) Act, 1978 — our product-backed model is exempt

12. Grievance Redressal

If you have any complaints or disputes, please contact our Grievance Officer:

  • Response time: Within 48 hours of receipt
  • Resolution timeline: Within 30 days as per regulatory requirements

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Chennai, Tamil Nadu.

14. Amendments

PWS reserves the right to modify these Terms at any time. Changes will be communicated via the Platform and SMS. Continued use after changes constitutes acceptance.
